"Our daughter Seren (meaning star in Welsh), was born in June 2012 as a result of a uterine rupture.  Her birth was incredibly traumatic and took an enormous toll, but the aftermath – learning of her brain injury and subsequent damage after weeks of what felt like our being kept ‘in the dark’ as parents - completely shattered the illusion that her being resuscitated and us both surviving was a miracle from which we’d come out unscathed!

The weeks and months that followed had us questioning and doubting everyone; we felt utterly unsupported and helpless in searching for answers as to why events unfolded as they had.  Whilst a Serious Case Review was being prompted into the Obstetric Department’s responses during the day of Seren’s birth, we set about searching for a solicitor to help us make sense of what seemed like deep and muddy waters.  I found Diane Rostron amongst the list of possibilities.  Her profile seemed very approachable and matter-of-fact, including video diaries of children and their families she had already assisted.

I personally spoke to numerous solicitors prior to appointing Diane and her team.  Many of the solicitors I spoke to discussed sums of money from the outset of our discussions, labelling our daughter’s Cerebral Palsy in increments with figures of money attached.  Some attempted to itemise a figure that would be reached as a compensatory cash sum as a result of my no longer being able to have children.  What struck me instantly about Diane is neither of us discussed money.  Our early conversations focused very much on what was happening in that first nine months; I obtained her invaluable guidance on questions to ask Seren’s Consultant Paediatrician in order to get a clearer picture of the injury.  With patience and very specific input, Diane was able to guide us on an approach to ensure we obtained our legal entitlement to a second opinion which secured a diagnosis of Cerebral Palsy.  This was the single, most pivotal aspect of that first year which enabled us to have some control over the situation we’d been thrust into.  It proved invaluable in ensuring Seren had access to specialist therapies earlier on which we strongly believe has made a huge difference to Seren’s long-term outlook living with Cerebral Palsy. 

 Instantly caring and reassuring, Diane brought with her to our first meeting – a copy of a book all about brain injuries that contained practical guidance to parents on ways of nurturing and harnessing other parts of the brain.  This typifies her approach – she’s adept and aware of prioritising what mattered to us at that time.  And the beauty about Diane is that, along with her perceptive and caring side, we’ve also been able to glimpse the ‘legal rottweiler’ beneath that calm exterior.  I’m simply glad she’s with us and not against us!

As our family have travelled our way along the legal process, we’ve been constantly reassured that we made the right decision in appointing Diane.  She is determined and highly competent and this makes us – as parents – feel far less pressured to secure a legal outcome for Seren in order to bolster her future when her start was less than favourable.  That’s afforded us the opportunity to focus on Seren’s early years and leave what’s still to come to a really professional team.  All of the professionals that form an integral part of Diane’s team–  from midwifery, obstetrics, neonatal and neurological experts – have given us insights into what occurred during Seren’s birth that had remained unanswered.  We haven’t finished our journey yet but we’re very confident that whatever negligence occurred, Diane’s team will be well-equipped to detect them and challenge the health board robustly!
